The terms that govern participation by nail technicians on the GLOZ platform.
These Nail Technician Terms & Conditions ("Technician Terms") govern participation by nail technicians and other approved nail-service providers ("Technicians") on the Gloz platform. Gloz LLC ("Gloz," "we," "us," or "our") operates a technology platform that connects customers seeking nail services at their requested locations, including their homes, with participating Technicians. By creating a Technician account, applying to provide services through Gloz, or accepting appointments through the Gloz platform, you agree to these Technician Terms.
Minimum Age and Eligibility
You must be at least 18 years old to create a Technician account, register as a Technician, accept appointments, or provide services through the Gloz platform.
By registering as a Technician, you represent and warrant that:
- You are at least 18 years old
- You are legally permitted to work and provide the applicable services
- You possess all licenses, registrations, certifications, and other credentials required by applicable law
- The information and documents you provide to Gloz are accurate, current, and complete
- You are legally capable of entering into these Technician Terms
Gloz may request documentation reasonably necessary to verify your identity, age, licensing, insurance, or eligibility.
Gloz may deny, suspend, or terminate access to the platform if eligibility requirements are not satisfied.
Independent Contractor Relationship
Technicians participate on the Gloz platform as independent contractors and not as employees of Gloz, except to the extent applicable law determines otherwise.
Nothing in these Technician Terms is intended to create an employer-employee relationship, partnership, joint venture, or agency relationship.
Subject to applicable law and platform requirements, Technicians independently determine whether to accept available service opportunities.
Technicians are responsible for their own business expenses, tools, supplies, transportation, insurance, taxes, and other obligations associated with operating independently, except where Gloz expressly agrees otherwise.
Nothing in these Technician Terms is intended to waive or alter any classification or employment rights that cannot lawfully be waived.
Licensing and Legal Requirements
Technicians must maintain all licenses, registrations, permits, certifications, and other qualifications required by federal, state, or local law for the services they provide.
This includes any requirements applicable to providing nail or manicuring services at customer-selected locations or private residences.
Technicians must promptly notify Gloz if any required license, registration, authorization, or qualification expires, is suspended, revoked, restricted, or otherwise becomes invalid.
Gloz may request proof of licensing or registration at any time.
A Technician may not accept or perform a service through Gloz that the Technician is not legally authorized or professionally qualified to perform.
Identity Verification and Background Screening
Gloz may require Technicians to complete identity verification and background screening before accessing some or all features of the platform.
Technicians agree to provide accurate information necessary for permitted verification procedures.
Where required by applicable law, Gloz or its screening provider will provide separate notices, disclosures, and authorizations concerning background checks.
Providing false, altered, misleading, or fraudulent information or documentation may result in rejection, suspension, or termination from the platform.
Insurance
Technicians must maintain insurance required by applicable law and any minimum insurance requirements communicated by Gloz as a condition of participation.
Where Gloz requires professional or general liability insurance, Technicians must maintain the required coverage while providing services through Gloz and provide evidence of coverage upon request.
Technicians must promptly notify Gloz if required insurance is canceled, expires, or materially changes.
Professional and Sanitation Standards
Technicians agree to:
- Provide services professionally and competently
- Follow applicable sanitation, disinfection, and hygiene requirements
- Maintain clean and appropriate tools and equipment
- Use products appropriately and according to applicable requirements
- Comply with applicable licensing, health, and sanitation regulations
- Treat customers and other persons at the service location respectfully
- Arrive reasonably on time for accepted appointments
- Perform only services they are legally permitted and professionally qualified to perform
- Maintain appropriate professional conduct while at customer locations
In-Home and Mobile Services
Gloz is designed to facilitate nail services at locations requested by customers, including private residences.
Technicians are responsible for complying with licensing, registration, mobile-service, sanitation, transportation, and other legal requirements applicable to providing services outside a traditional salon.
Technicians should perform services only at locations where they can reasonably and lawfully provide the requested service.
If circumstances at a customer location prevent the service from being lawfully or reasonably performed, the Technician may decline or discontinue the service and should report the situation to Gloz.
Service Requests and Appointments
Technicians may receive opportunities to provide services through the Gloz platform.
Subject to platform rules and applicable law, Technicians may decide whether to accept an available appointment.
Once an appointment is accepted, the Technician agrees to make reasonable efforts to arrive as scheduled and complete the requested service according to the booking details.
Repeated cancellations, excessive lateness, fraudulent activity, or other conduct materially affecting platform reliability may result in account restrictions or termination.
Payments and Gloz Fees
Customer payments for appointments arranged through Gloz are processed through the Gloz platform or its authorized payment-processing providers.
Gloz may deduct its disclosed commission, platform fees, refunds, chargebacks, adjustments, taxes required to be withheld, or other authorized amounts before paying the Technician.
Applicable commissions, fees, payout schedules, and other payment terms may be disclosed through the Technician application, platform, agreement, or applicable fee schedule.
Technicians may receive customer tips where supported by the platform.
Taxes
Technicians are responsible for determining and satisfying their federal, state, and local tax obligations arising from earnings received through Gloz.
Where required, Gloz may collect taxpayer information and issue applicable tax-reporting documents, including Form 1099 or other required forms.
Technicians are responsible for obtaining independent tax advice concerning their individual circumstances.
Customer Information and Privacy
Technicians may receive customer information solely as necessary to perform services arranged through Gloz. This information may include a customer's name, service location, contact information, appointment details, and other information reasonably necessary to complete an appointment.
Technicians may not:
- Sell customer information
- Use customer information for unauthorized marketing
- Retain customer information for unrelated purposes
- Share customer addresses, telephone numbers, or other personal information without authorization
- Publish customer information or appointment details on social media without appropriate permission
- Use information obtained through Gloz for unlawful purposes
Technicians must handle customer information in accordance with applicable privacy laws and Gloz policies.
Platform Circumvention
Technicians may not improperly use customer information or relationships obtained exclusively through Gloz for the purpose of intentionally circumventing applicable Gloz platform fees or interfering with the operation of the Gloz platform.
Any restriction under this section applies only to the extent permitted by applicable law.
Technician Conduct
Technicians may not engage in:
- Harassment
- Discrimination prohibited by law
- Threatening or intimidating behavior
- Theft
- Fraud
- Violence
- Sexual harassment or sexual misconduct
- Unauthorized use of customer property
- Illegal activity
- Providing services while impaired by alcohol or drugs
- Conduct that materially endangers customers or other persons
Serious violations may result in immediate suspension or termination from the Gloz platform.
Services Involving Minors
Technicians must not knowingly provide services to a minor through an account created by the minor.
Appointments for persons under 18 must be booked through an eligible adult account holder and are subject to Gloz's applicable customer policies.
Gloz may require a parent, legal guardian, or other responsible adult to remain present at the service location while a service is being provided to a minor.
Technicians should not proceed with an appointment involving a minor when the circumstances do not satisfy applicable Gloz policies or legal requirements.
Ratings, Reviews, and Customer Feedback
Customers may have the opportunity to rate and review Technicians.
Gloz may use legitimate quality indicators, including ratings, complaints, cancellation history, and reliability information, to administer the platform.
Gloz may investigate customer or Technician complaints and take appropriate action consistent with applicable law and Gloz policies.
Communications and SMS/Text Messaging
Gloz may communicate with Technicians regarding appointments, customer requests, account administration, identity or license verification, payouts, platform operations, support, and other matters relating to participation on the platform.
Where consent is required for SMS/text communications, Gloz will obtain the appropriate consent. For recurring SMS programs: message frequency varies, and message and data rates may apply. Reply STOP to opt out of recurring SMS messages, or HELP for assistance.
Where applicable, opting out of optional SMS communications does not terminate the Technician's Gloz account. Important communications may instead be provided through the application, email, or other permitted methods.
Intellectual Property
Gloz retains all rights in the Gloz name, trademarks, logos, software, application, website, designs, content, technology, and other proprietary materials.
Participation as a Technician does not transfer ownership of Gloz intellectual property to the Technician.
Technicians may use Gloz branding only as authorized by Gloz.
Suspension and Termination
Gloz may suspend, restrict, investigate, or terminate Technician access for legitimate reasons, including:
- Failure to meet the minimum age requirement
- Loss or expiration of required licensing or registration
- Fraud or falsified documentation
- Serious customer complaints
- Safety or security concerns
- Repeated failure to complete accepted appointments
- Violation of these Technician Terms
- Failure to maintain required insurance
- Illegal conduct
- Misuse of customer information
- Material misuse of the Gloz platform
Nothing in this section limits rights that cannot legally be waived.
No Guaranteed Appointments or Earnings
Gloz does not guarantee any minimum number of bookings, customers, appointments, working hours, revenue, or earnings.
Demand may vary based on customer demand, location, availability, pricing, seasonality, ratings, and other factors.
Disclaimer
To the fullest extent permitted by applicable law, the Gloz platform is provided on an "as available" basis.
Gloz does not guarantee the availability of customers, appointments, platform functionality, or any particular amount of income.
Nothing in these Technician Terms excludes warranties, protections, or remedies that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Gloz will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from participation on or use of the Gloz platform.
Any limitation contained in these Technician Terms applies only to the extent permitted by applicable law.
Governing Law
These Technician Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable federal law or another applicable law requires otherwise.
Changes to These Technician Terms
Gloz may update these Technician Terms periodically. Technicians will receive notice of material changes where required by applicable law. Continued use of the platform following an update may constitute acceptance where permitted by applicable law.
Privacy
Gloz's collection and use of Technician personal information is governed by the Gloz Privacy Policy.
